Terms of Service

Standard trading conditions and terms governing freight forwarding and logistics services by Capstone Shipping Pvt. Ltd. Last updated: May 2025.

1. Services

Capstone Shipping Pvt. Ltd. ("Capstone", "we", "us") provides freight forwarding, customs brokerage, warehousing, third-party logistics, and related services as a PIFFA-licensed freight forwarder. All services are subject to these Terms and to the FIATA Standard Trading Conditions where applicable.

2. Quotes and Rates

All freight quotes are valid for the period stated (typically 7 days) and are subject to carrier rate fluctuations, surcharge changes, and space availability. Confirmed bookings at a quoted rate are binding. Capstone reserves the right to adjust rates for shipments where cargo weight, volume, or commodity differs materially from the information provided.

3. Liability

Capstone acts as an agent for the shipper/consignee and as a principal where NVOCC services are provided. Our liability for loss or damage to cargo is limited to the lesser of: the actual value of the loss or damage, or the applicable carrier limitation under the applicable bill of lading or airway bill. Capstone strongly recommends cargo insurance for all shipments.

4. Customs and Regulatory Compliance

The client is responsible for ensuring that all goods comply with applicable import and export laws, regulations, and permit requirements. Capstone provides customs clearance as an agent acting on the client's instructions. The client warrants that all information provided for customs declarations is accurate and complete. Capstone shall not be liable for delays, penalties, or seizures arising from incorrect or incomplete information.

5. Payment Terms

Freight charges, customs duties, and applicable fees are payable as agreed in the service agreement or individual quotation. Capstone reserves the right to exercise a general lien on cargo in its possession for any outstanding amounts. Overdue payments are subject to interest at the applicable State Bank of Pakistan rate.

6. Force Majeure

Capstone shall not be liable for delays or failure to perform due to circumstances beyond its reasonable control, including natural disasters, port congestion, carrier delays, government actions, strikes, or any other force majeure event.

7. Governing Law

These Terms are governed by the laws of Pakistan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lahore, Punjab, Pakistan.

8. Amendments

Capstone reserves the right to update these Terms at any time. The current version is always published at this URL. Continued use of our services after any update constitutes acceptance of the revised Terms.
